Lease Space Needs for State Agency Operations

Under the statutory authority derived from the Public Buildings Law (PBB), the Office of General Services is empowered to lease privately-owned space for Executive Branch State agency operations.

OGS’ standard procedures for most requirements involve advertising the space need in the NYS Contract Reporter, notifying landlords/developers in the geographic area of the requirement, and posting the specific requirements on this OGS Website with a Request for Information (RFI) and appropriate contact persons. If any interested landlord/developer or other persons would like to review the final results of any RFI or to discuss our processes for leasing space they should contact the Director, Real Estate Planning and Development Group at 518-474-4944.

The State of New York, Office of General Services is seeking proposals from qualified landlords interested in entering into a 10-year lease agreement pursuant to the Public Buildings Law, to provide approximately 6,432 usable square feet of space consisting of approximately 2,000 square feet for an exterior secured area (for impound purposes), 1,800 square feet of garage space and interior office space of about 2,632 usable square feet including circulation, within the geographic area defined as no more than 5-10 miles north or south of I-287 in the corridor from Tarrytown eastward to Port Chester, south to Mamaroneck, for 7 employees.

Prevailing Wages

In relation to all new construction, major renovations, or substantial capital improvements performed under this Lease, Landlord shall abide by the provisions of Article 8 of the State Labor Law. In addition, the Landlord agrees that the wages to be paid any worker, laborer, mechanic, floor waxer, or office cleaner for cleaning and maintenance of the Demised Premises shall not be less than the prevailing wage for the locality in which the work is to be performed. Prevailing wage schedules may be obtained from the New York State Department of Labor.

Build-out Requirements

The space requirement totals approximately 6,432 USF and includes space for the operation of the local Field Investigation Office of the Department of Motor Vehicles agency. In general terms, the space will include three components: 1) an office section (approx. 2,632 USF) housing an approximately 70/30 built/open environment consisting of offices, open plan workstations, customer waiting area including unisex ADA-accessible rest room, changing/locker room space, interview room, office and secured storage, lunchroom, other support functions and bathrooms; 2) a garage space (approx 1,800 USF) with three (3) bays to be used for car and truck inspections; and 3) a fenced and secured area for vehicle impound (approx. 2,000 USF).

Restrooms shall be ADA-compliant.

Electrical and tel/data needs shall be consistent with the normal office operations, including duplex and a few quadplex outlets, tel/data outlets (boxes, conduit above the ceiling by Landlord’s vendor, cabling by others), and garage bay power for electric lifts, compressors, etc.

Lighting shall be by fluorescent fixtures, switched individually at the entry doors to each room.

HVAC shall include heating, ventilation, and cooling in the office portion, and heating and ventilation in the garage section. HVAC shall be controlled by thermostats in the OGS space and sized and installed in compliance with applicable ASHREA guidelines and typical of nearby Class B building systems.

Green Lease Requirements

The Office of General Services recognizes the need to reduce negative impact on the environment by incorporating sustainable design, construction, and cleaning principals within leased buildings to enhance the health and comfort of individuals as well as reduce consumption of renewable and non-renewable resources and minimize waste.

In order to realize this objective, OGS will consider new, or existing structure(s) only with associated building upgrades designed and built to meet the needs of the agency and consistent with Executive Order 111 in regards to energy efficiency practices.

Landlords who have state agencies occupying space in their facilities are also encouraged to implement and maintain the cleaning of the Premises and common areas of the building in conformance with Executive Order 134 which encourages the use of green cleaning products and best cleaning management practices.

Terms

The occupancy and lease commencement is anticipated to be September, 2010. Proposals should be for a term of ten (10) years. Proposed base rental rates shall reflect the cost of a “turnkey” lease and shall include: base taxes and operating costs, janitorial service, repair and maintenance to the demised premises (including normal wear and tear) through the term, midterm painting, and parking for 15 vehicles; terms and availability of any additional parking available to the Tenant should be noted on the Business Terms Sheet.

Eligibility / Qualifications / Requirements / PreferencesProposals should include only sites within geographic area defined as no more than 5-10 miles north or south of I-287 in the corridor from Tarrytown eastward to Port Chester, south to Mamaroneck. Submissions will be accepted, in writing, only from developers with site control, property owners, or their exclusive agents. The Commissioner of the Office of General Services at his sole discretion may reject any or all submissions. NYS Finance Law Sections 139-j and 139-k imposes certain restrictions on communications between an Offerer and the State during the procurement process. An Offeror is restricted from making contact to other than designated staff (OGS Bureau Chief, Joseph Luvera, OGS Project Mgr, Donn Courselle, United Systems Integrators Corporation (USI) Tenant Broker, Kerry Maloy, and USI Field Delivery Team Member Paul Ferraro, acting as agents for OGS for this purpose) from the date of the issuance of this Web notification through final award and approval of the lease by the Office of the State Comptroller (“restricted period”).

Some major factors in determining a potential lease location are fair market value, overall move costs, equitable lease terms and targeted occupancy dates. Cost considerations, however, are of the utmost importance. In accordance with Governor Paterson’s directive, State Agencies must limit spending to more affordable levels. Accordingly, OGS and our Tenant agencies are looking for Landlords to advance creative proposals for reducing costs and streamlining of operations in Leased Spaces.


Proposals must include a scaled architectural or CAD Drawing (AutoCAD Version 2006) of the space and a completed copy of the first 6 of the following 11 documents:

The State of New York, Office of General Services (OGS) is seeking proposals from qualified landlords interested in entering into a 5 or 10-year lease agreement pursuant to the Public Buildings Law, to provide approximately 15,644 usable square feet of general office space, within the City of Rochester, for 73 employees. A preference will be given to sites located within the City of Rochester Downtown Business District.

Prevailing Wages

In relation to all new construction, major renovations, or substantial capital improvements performed under this Lease, Landlord shall abide by the provisions of Article 8 of the State Labor Law. In addition, the Landlord agrees that the wages to be paid any worker, laborer, mechanic, floor waxer, or office cleaner for cleaning and maintenance of the Demised Premises shall not be less than the prevailing wage for the locality in which the work is to be performed. Build-out Requirements

Space requirements include:
(15) private offices ranging in size from 125 SF to 225 SF, (58) workstations grouped in independent suites or open office areas, and common areas for office equipment, files/reference and team meetings. Conferencing spaces to include (2) 250 SF and (1) 500 SF Conference Rooms, (3) Interview Rooms: 100-125 SF, a HR Privacy Room, a 300 SF Library and 150 SF Reference Room, supported by (6) separate reception/waiting areas totaling approximately 875 SF and a 200 SF scheduling area. Other spaces include but are not limited to: a 200 SF Laboratory Room, a 150 SF and 500 SF Storage Rooms, a 285 SF employee Lunch Room with kitchenette, and a 150 SF Server LAN Room. Additional small LAN Room or closet may be required for telecommunication distribution when one large floor or several floors are offered.

Building, suite, common areas and bathrooms for both employees and visitors are to be ADA accessible.

Electrical and telecommunications/data needs include standard office requirements: for each workstation provide (1) duplex computer power outlet, (1) combination data/telephone outlet, & (3) duplex electrical outlets. Specialty spaces will also require standard and computer receptacles with data/telephone receptacles. Additional power and supplementary cooling will be needed for the LAN Rooms, support of the security functions required. Provide sufficient power for equipment and electrical convenience outlets per code. Power allocated to the Agency to be separate from other users, measured by a separate meter.

Independent control of the HVAC system is needed; special requirements for the LAN and security functions are anticipated. Plumbing: required bathroom fixtures and sinks, hot/cold water and drains for the kitchenette in the Lunch Room. Light and noise level to be within acceptable office environment range.

Green Lease Requirements

The Office of General Services supports the State of New York in its policies of conserving, improving and protecting natural resources and the environment; preventing water, air and land pollution; and enhancing the health, safety and welfare of State residents and their overall economic and social well-being by incorporating the provisions of Executive Orders 111, 134 and 4 into State leases and promoting further sustainable environmental stewardship through our Sustainable-Green Items Checklist.

Information regarding the aforementioned Executive Orders can be found below. A link to the Sustainable-Green Items Checklist can be found near the end of this document. Please note that a completed copy of the Checklist must be submitted with your proposal.

Executive Order 111: State Entities procuring leased space to fulfill their mandated program responsibilities are directed, to the best of their ability, to incorporate energy-efficient design, operations, and management practices, in any space they lease from private Landlords.

Executive Order 4: Directs state entities to green their procurements and to implement sustainability initiatives including source separating recycling practices. The Order contains an annual reporting requirement. Landlords will be requested to assist agencies in fulfilling the solid waste management section of this report. Terms

Proposals should include a description of any assistance to be provided by the Landlord to the agency to aid in the generation of an annual waste stream audit as mandated under Executive Order 4, including any costs to Tenant involved. The reporting information will include the quantity and the unit of measure, i.e. tons, cubic yards, gallons, units, etc., for all solid waste and source separated materials generated by the Tenant agency on an annual basis, as well as any special wastes disposed or recycled such as fluorescent light bulbs, tires, or mercury containing equipment.
